This is the first occasion in its history upon which this Court has upheld a preliminary objection not offered as a challenge to the Court's jurisdiction. The taking of this step is a matter of importance, and as I am unable to share the views which have led to it, I feel that it is incumbent upon me to set forth my opinion in dissent.
