What are Incoterms?

Incoterms are a set of standard terms of delivery commonly used in international trade, issued by the International Chamber of Commerce (ICC), Paris. Incoterms are accepted by governments, legal authorities and practitioners worldwide for the interpretation of the most commonly used terms in international trade. They clearly state the responsibilities of the parties concerned and cover matters such as terms of sale, point of origin, destination, and the exact moment at which ownership of goods passes from one party to another. The use of Incoterms helps prevent the legal complications that can arise from misunderstandings on such matters as who is to pay for ancillary freight charges, consular fees, losses during transit or pilferage. It should be remembered that unless the Incoterms have been incorporated into the domestic law of the relevant country, they do not automatically apply unless there is reference to them in the sales contract or in the transport documents.
