La constitution ou la nomination d’un tribunal d’arbitrage est généralement la première étape d’une procédure d’arbitrage. Elle est souvent amorcée par l’émission d’une requête ou notification d’arbitrage par le plaignant à l’attention de l’intimé ou d’une institution d’arbitrage. Selon les règles applicables, la création du tribunal peut être assurée par une institution d’arbitrage, par les parties elles-mêmes ou par un tribunal.
