Settlement of trade disputes

Foreign companies confronting a trade remedy case often ask if there is some way to ‘settle’ the case. This question is not surprising. After all, many lawsuits in the United States are settled. Moreover, in other countries ‘undertakings’ to settle anti-dumping cases are quite common. The situation in the United States, however, is more complicated. Settlements of anti-dumping and countervailing duty cases are the exception rather than the rule.
