In the month of September 1882, a boundary treaty was concluded between the Governments of Guatemala and Mexico, determining the principal points to be followed by the respective commissions of engineers appointed under that treaty for the definite delimitation of the frontier of both countries. Unforeseen difficulties prevented the demarcation and erection of landmarks on the whole of the line in the time agreed upon. The Government of Guatemala, undei the conviction of making use of its rights, exercised acts of sovereignty during the discussion over the right to certain lands. By the Convention of April 1, 1895, it agreed to indemnify the Mexican citizens injured by its agents for the value of properties occupied or destroyed and for the damages directly occasioned thereto by such occupation or destruction. The Convention provided for the appointment, by common consent, of an Arbitrator to fix the amount of these indemnities.
