Voluntary Peer Review of Competition Law and Policy - Paraguay

The review evaluates Paraguay's competition system examining its legal framework and practical application of competition law. It analyzes the current situation based on extensive research and expert opinions gathered during a visit to Asuncion in October 2022. This includes a review of constitutional text competition laws regulations and decisions by the Competition Agency (Conacom). Despite having a competition law for 10 years enforcement faces challenges due to resource constraints. Conacom has investigated few cases of restrictive practices and abuses of dominant position consistently rejecting accusations by the Investigation Directorate. Sanctions lack deterrence capped at 150% of profits or 20% of sales potentially leading to minimal penalties. Moreover the absence of an immunity and leniency program is a major shortcoming in Paraguay's competition enforcement and advocacy efforts.

Paid domestic work employs many women in developing countries. Paraguay where 94 percent of domestic workers are women and more than 90 percent of these jobs are informal represents an extreme case of a problem that is common throughout the globe. These workers lack access to social security and generally endure precarious working conditions. What are the different legal institutional social and gender barriers that prevent domestic workers from having greater access to social security? Drawing on different sources of data from Paraguay including the voices of both domestic workers and their employers this study shows how persistently low levels of social security coverage in this sector are a product of complex interlocking factors: discriminatory cultural and gender beliefs lack of accurate information and knowledge about social security the low bargaining power of informal domestic workers and the low capacity for labour inspection that prevail in the sector. Based on these observations the conclusions lay out guidelines to design integrated public policies for the sector’s formalization.

En el presente artículo se hace un análisis socioespacial de la transformación urbana que ha tenido lugar en la ciudad de Encarnación (Paraguay) fronteriza con la ciudad de Posadas Argentina a la luz de los grandes cambios ocurridos en el frente fluvial de la ciudad debido a la central hidroeléctrica Yacyretá construida por ambos países. Se lleva a cabo un análisis descriptivo y documental de cómo a partir del papel que desempeñaron las obras complementarias de tratamiento costero y los agentes inmobiliarios y de desarrollo local surgieron nuevos procesos urbanos que configuraron el territorio. Se concluye que el patrón tradicional de segregación de la ciudad se está modificando a partir del desplazamiento de la población la construcción de grandes obras y la revalorización del nuevo frente costero.

Social Capital in Paraguay: An Asset for Combatting Vulnerability During the COVID-19 Pandemic?

Solidarity has been a hallmark of the COVID-19 pandemic response in Paraguay. Many vulnerable communities have found ways to survive in the crisis context by mobilizing support from community and volunteer networks and civil society organizations and also by accessing institutional forms of support such as cash transfer programmes. How pervasive is collective action in vulnerable territories during the pandemic? Who engages in collective action and to what end? And does it reduce vulnerability? This policy brief reports preliminary results of a survey on social capital in selected territories of Paraguay and its relationship with economic vulnerability during the first year of the COVID-19 pandemic. The data presented provide insights into how trust and social capital have enabled collective action in vulnerable territories of Paraguay during the pandemic. This evidence can inform policy debates on how to increase resiliency and reduce vulnerability and allow us to identify design and evaluate interventions to increase access to formal and informal types of aid in vulnerable territories.

Undertaken by UNCTAD at the request of the Ministry of Industry and Trade (MIC) of Paraguay this review supports the role of services in diversifying and improving economy and trade in the country. It evaluates bottlenecks and opportunities to pursue development gains from services first presenting a related economic and trade assessment. It subsequently analyses Paraguay’s development strategies trade negotiations and other initiatives in services before offering detailed assessments on fluvial transport services and professional services associated with the construction sector. Finally it concludes with an analysis of cross-cutting and makes sectoral-specific policy recommendations.
