يحظر قانون حماية المنافسة بعض الأتفاقات ا أ لأفقية، والأتفاقات الرأسية المقيدة لحرية المنافسة، وإساءة استخدام الوضع المسيطر، والتركزات الأقتصادية التي تقيد حرية المنافسة أو تحد منها أو تضر بها إلى حد كبير. ومع ذلك، انبثقت عن هذا ا إ لأطار القانوني عدة قضايا، وهو لأ يغطي بشكل كاف المسائل المتعلقة بالممارسات الأحتكارية أو المسائل المتعلقة با أ لأسواق الرقمية. وينشأ الجدل أيضاً حول الأختصاص فيما يتصل بالمنافسة في قطاع الأتصالأت، وصلاحيات مكافحة الممارسات الأحتكارية والرقابة على التركزات الأقتصادية التي يتمتع بها البنك المركزي المصري وتتمتع بها الهيئة العامة للرقابة المالية. وهذا يستلزم إجراء مقارنة مع أفضل الممارسات الدولية، يمكن أن تقدم توصيات مفيدة ل إ لاصلاح.
Impressions of the United Nations set of principles and rules on competition
The Set of Multilaterally Agreed Equitable Principles and Rules for the Control of Restrictive Business Practices (Set) provides a common framework for cooperation and dialogue among competition authorities, recognizing the special needs and challenges of developing countries and offering flexibility for them to pursue development goals.
Methodology
The eTrade Readiness Assessment was conducted to identify the main barriers and opportunities for e-commerce development in the seven eTrade for all policy areas by providing a detailed diagnostic of the digital ecosystem and identifying key policy actions for which support can be mobilized.
Los procesos y retos posteriores a la reclasificación
Desde la aprobación en 2011 del Programa de Acción en favor de los Países Menos Adelantados para el Decenio 2011-2020 (Programa de Acción de Estambul), se ha prestado una atención considerable a la viabilidad de la meta de reclasificación que contiene (Guillaumont and Drabo, 2013; Kawamura, 2014).

The United Nations Set of Principles and Rules on Competition: Synergies and complementarities with other formative work on competition issues at the multilateral level
The Set of Multilaterally Agreed Equitable Principles and Rules for the Control of Restrictive Business Practices (Set) and related work are of direct, continuing relevance to the realization of the the United Nations Sustainable Development Goals (SDGs), inspiring the elaboration of national competition policies and possible future developments at the multilateral level.

يوصي استعراض ا أ لأقران الطوعي الذي أجراه مؤتمر ا أ لأمم المتحدة للتجارة والتنمية )ا أ لأونكتاد( لقوانين وسياسات المنافسة في مصر، في جملة أمور، بما يلي: 1( إدخال تعديلات وتحديثات جوهرية على ا أ لأحكام الواردة في قانون حماية المنافسة ( ولأئحته التنفيذية؛ و) 2( يُنصح جهاز حماية المنافسة بنشر إرشادات وقوانين غير ملزمة تتعلق بالتركزات الأقتصادية، باعتباره الجهة التي تمارس اختصاصاً حصرياً في جميع المسائل المتعلقة بالمنافسة في جميع القطاعات، وبتعزيز أشكال التعاون الرسمي مع البنك المركزي المصري والهيئة العامة للرقابة المالية؛ و) 3( يجب تنقيح قانون حماية المنافسة وولأية جهاز حماية المنافسة لمنح الجهاز مزيداً من الأختصاصات والأستقلال بشكل عام من أجل تعزيز الكفاءة وضمان إنفاذ القانون بفعالية أكبر. وبهذه الطريقة، يمكن تعزيز ا إ لأطار القانوني وا إ لأطار المؤسسي لقانون المنافسة في مصر.
