Le présent ouvrage contient les résumés des arrêts avis consultatifs et ordonnances portant sur des questions de fond rendus entre le 1er janvier 2018 et le 31 décembre 2022 par la Cour internationale de Justice l’organe judiciaire principal des Nations Unies. Il fait suite à six volumes du même type (ST/LEG/SER.F/1 ST/LEG/SER.F/1/Add.1 ST/LEG/ SER.F/1/Add.2 ST/LEG/SER.F/1/Add.3 ST/LEG/SER.F/1/Add.5 et ST/LEG/SER.F/1/Add.6) qui portaient respectivement sur les périodes allant de 1948 à 1991 de 1992 à 1996 de 1997 à 2002 de 2003 à 2007 de 2008 à 2012 et de 2013 à 2017. Durant la période considérée la Cour a rendu vingt-neuf arrêts avis consultatifs et ordonnances portant sur des questions de fond. Il échet de souligner que les résumés publiés ci-après ont été préparés par le Greffe de la Cour et ne sauraient engager la responsabilité de celle-ci.

United Nations System Common Position on Incarceration
The present paper sets forth the United Nations system common position on incarceration. It addresses prison and associated challenges at the global regional and national levels and constitutes the common framework for United Nations support to Member States in relation to incarceration. The paper reflects a “One UN” approach aimed at supporting efforts to rethink the current overreliance on and implementation of incarceration including through better coordination and integrated efforts. The United Nations system common position on incarceration is based on the understanding that no one should be subjected to arbitrary arrest or detention and that the deprivation of liberty in response to a criminal charge or offence should constitute a measure of last resort with due consideration first being paid to non-custodial sanctions or measures. It also acknowledges that as part of individualized balanced and proportionate criminal justice responses to offending well managed prisons constitute an important aspect of the justice chain. Prison services that respect human dignity and operate in line with international norms and standards constitute a core element of efforts to maintain peace and security public safety and respect for human rights.

Voluntary Peer Review of Competition Law and Policy - Paraguay
The review evaluates Paraguay's competition system examining its legal framework and practical application of competition law. It analyzes the current situation based on extensive research and expert opinions gathered during a visit to Asuncion in October 2022. This includes a review of constitutional text competition laws regulations and decisions by the Competition Agency (Conacom). Despite having a competition law for 10 years enforcement faces challenges due to resource constraints. Conacom has investigated few cases of restrictive practices and abuses of dominant position consistently rejecting accusations by the Investigation Directorate. Sanctions lack deterrence capped at 150% of profits or 20% of sales potentially leading to minimal penalties. Moreover the absence of an immunity and leniency program is a major shortcoming in Paraguay's competition enforcement and advocacy efforts.

The UNCTAD Model Law on Competition After 30 Years - Some Reflections
UNCTAD Model Law on Competition (Model Law) has been developed by member States’ representatives gathered in UNCTAD intergovernmental meetings to provide guidance on competition legislations particularly for developing countries that are not familiar with this field recognizing their interest to be able to take appropriate actions towards anticompetitive practices. The discussion on the Model Law in UNCTAD dates back to the 1970s when only around 20 jurisdictions in the world had competition laws and authorities and most were developed countries. This publication revisits the Model Law from different angles; the origin and history of the Model Law as well as its negotiation are discussed. Testimonials from young competition authorities from developing countries share the relevance of the Model Law in the drafting of their own competition laws and refer to the implications of the Model Law to developing countries.
