Promoção da diversidade e da igualdade: Obrigações de enfrentar as causas fundamentais da discriminação
O propósito do presente guia é fornecer aos legisladores e defensores de direitos humanos orientações claras e acessíveis para o desenvolvimento de legislações abrangentes contra a discriminação. Seu objetivo é consolidar e sintetizar as normas jurídicas internacionais relacionadas à natureza alcance e conteúdo dessas legislações. Como demonstrado ao longo deste artigo a adoção de tais leis é essencial para que os Estados cumpram suas obrigações internacionais de direitos humanos de respeitar proteger e garantir o direito à não discriminação. No entanto embora seja absolutamente necessário a promulgação e aplicação de leis antidiscriminação abrangentes não são por si só suficientes para cumprir tais obrigações.

Lorsqu’ils décident de devenir parties à la Convention les États peuvent compter sur l’appui de divers partenaires nationaux et internationaux à chaque étape du processus mais aussi ultérieurement dans le cadre de la mise en oeuvre du traité.
Resumo executivo
O presente guia tem como objetivo prover orientações oficiais aos governos legisladores atores da sociedade civil e demais interessados que atuam no interesse público acerca do desenvolvimento de legislação abrangente contra a discriminação em consonância com as normas jurídicas internacionais que garantem os direitos à igualdade e à não discriminação. O guia examina de forma detalhada o desenvolvimento interpretação e implementação das normas internacionais mencionadas com o objetivo de estabelecer os princípios basilares que devem ser codificados em lei a fim de assegurar a conformidade com o direito internacional. Neste resumo executivo são apresentados os princípios fundamentais referidos.

Одной из общих задач которыми занимаются законодательные и директивные органы при разработке законов о запрете на дискриминацию является установление границы между нормами запрещающими ненавистнические высказывания с одной стороны и антидискриминационным законодательством с другой.

Pour quelles raisons tous les états devraient-ils devenir parties à la convention?
La ratification universelle de la Convention reste un objectif à atteindre. À la date de publication du présent guide 72 États membres de l’Organisation des Nations Unies sont devenus parties à la Convention soit par ratification soit par adhésion. Vingt-neuf (29) États parties ont reconnu la compétence du Comité des disparitions forcées pour recevoir et examiner des communications (plaintes) individuelles et 28 ont accepté la compétence du Comité pour examiner des communications interétatiques. Quarante-deux (42) États ont signé la Convention mais ne l’ont pas encore ratifiée.

Under Article 102 of the Charter of the United Nations every treaty and every international agreement entered into by any Member of the United Nations after the coming into force of the Charter shall as soon as possible be registered with the Secretariat and published by it. Furthermore no party to a treaty or international agreement subject to registration which has not been registered may invoke that treaty or agreement before any organ of the United Nations. The General Assembly by resolution 97 (I) established regulations to give effect to Article 102 of the Charter (see text of the regulations vol. 859 p. VIII; https://treaties.un.org/Pages/Resource.aspx?path=Publication/Regulation/Page1_en.xml).
